Digital Millennium Copyright Act Policy

Welcome to DriverHelpService.com (the “Site”), operated by or on behalf of Motorcar Tech Services Ltd. We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorised agents may submit a takedown notice to us as outlined below.

As a service provider, we rely on the safe harbour provisions of the DMCA and will respond promptly to properly submitted copyright infringement notices.

Notice of Infringement – Claim

To submit a valid copyright infringement claim, your written notification must include the following:

1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the allegedly infringing material and sufficient information to permit us to locate the material (including the specific URL of the page in question);
4. Contact information sufficient to allow us to contact you, including your full name, address, telephone number, and email address;
5. A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law;
6. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are authorised to act on behalf of the copyright owner.

Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and legal fees.

Please be aware that we may forward the details of any DMCA notice, including your contact information, to the party that allegedly posted the infringing material. By submitting a notice, you consent to this disclosure.

Counter Notification – Restoration of Material

If material you posted has been removed due to a DMCA notice, you may submit a counter notification. Your counter notice must be in writing and include the following information pursuant to 17 U.S.C. §512(g)(3):

1. Your physical or electronic signature;
2. Identification of the material that has been removed and the location where it appeared before removal;
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification;
4. Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or, if outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the party who submitted the original infringement notice.

Repeat Infringer Policy

We maintain a policy of terminating, in appropriate circumstances, users who are repeat infringers. We reserve the right to suspend or terminate accounts that are the subject of multiple valid DMCA notices.

We reserve the right to amend this DMCA Policy at any time. Updates will be posted on this page, and continued use of the Site constitutes acceptance of any changes.
